Respondents published in the Nigerian Observer of Saturday, July 31, 1971 the following:-
A Lagos High Court has adjourned the hearing till September 13 in the N2,000.00 embezzlement suit against a Lagos Building Contractor, Mr. J.I, Okolo."
Appellant stated that the publication was defamatory of him. Respondents argued that the publication was not capable of conveying any defamatory meaning and did not.
The plaintiff/appellant adduced evidence but the defendant/respondents adduced none.
Learned trial judge dismissed the claim holding that the words did not convey any defamatory meaning when read along with all that accompanied it in the newspaper.
